Welcome to ToyMoy! These Terms and Conditions (“Terms”) govern your access to and use of the ToyMoy website and services. By accessing our website or placing an order with ToyMoy, you (the “User” or “Customer”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our site or services.
ToyMoy is a business registered in Ontario, Canada. Our services are offered to you conditioned on your acceptance of these Terms, as well as our Privacy Policy (which governs how we handle your personal information). Please read these Terms carefully before using the service or submitting any orders.
Service Description: ToyMoy creates custom 3D-printed models based on children’s drawings submitted by customers. Through our website, you can upload an image of a drawing and provide instructions. ToyMoy will then transform that drawing into a physical three-dimensional model using 3D printing technology. Note that these models are intended as display or keepsake items and not as toys for play. While children may enjoy the final product as a decoration or collectible, the models may contain small or delicate parts and are not designed to be handled roughly by young children.
We aim to capture the essence of the provided drawing in the 3D model, but please understand that some artistic interpretation and structural adjustments may be required to ensure the model can be printed and is stable. The resulting product may not be an exact replica of the drawing, but we strive to remain faithful to its spirit.
Adults Only: You must be at least the age of majority in your jurisdiction (18 years or older in most provinces, including Ontario) to use the ToyMoy service. Our website and ordering process are intended for adults (typically parents or guardians submitting on behalf of their children). We do not knowingly offer accounts or collect personal information from children under 13. If you are under the age of majority, you may only use this service under the supervision and with the involvement of a parent or legal guardian, who must place the order on your behalf.
By submitting an order or information to ToyMoy, you represent and warrant that you are eligible to do so and that all information you provide is accurate and truthful.
4.1 Ownership of Drawings: You retain all rights to the original artwork (drawing) that you submit to us. ToyMoy does not claim ownership of your or your child’s drawings. The intellectual property rights in the content you provide remain with you or the original creator.
4.2 License to ToyMoy: By submitting a drawing or any content to ToyMoy, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and adapt that content solely for the purpose of creating your 3D model and providing our service to you. This means we have your permission to download, view, and digitally model your drawing, and to 3D print a model based on it. We will not use your submitted artwork for any other purpose without your explicit consent. We do not sell or redistribute your drawings or models to anyone else; your creation is personal to you.
4.3 User Responsibilities for Submitted Content: When you submit a drawing to ToyMoy, you represent and warrant that:
5.1 Ordering Process: To place an order, you will need to fill out the submission form on our website with the required information (your name, contact details, shipping address) and upload the drawing file(s) you want turned into a model. Once submitted, we will review your request. We may contact you via email or phone to confirm details, clarify any uncertainties in the drawing, or discuss any special requests you mentioned.
After we have reviewed your submission and confirmed that we can create the model, we will send you an order confirmation via email, including details of the product, the price, and an invoice for payment.
5.2 Pricing: The price for our service (including the creation of the 3D model and the product itself) will be communicated to you before you are charged. All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Prices may be subject to applicable taxes (e.g., HST for orders within Canada) which will be indicated at the time of invoicing. Shipping fees, if any, will also be outlined in the order details before you make payment.
5.3 Payment Terms: Payment is required before we begin production of your custom 3D model. Once you confirm you wish to proceed with the order, ToyMoy will send you a secure electronic invoice via Square (to your provided email address). You can pay this invoice using the payment methods Square supports (such as credit card). Payment processing is conducted by Square on their secure servers; ToyMoy itself will not ask you for credit card numbers on our website.
Prompt payment is appreciated so we can start working on your model. If payment is not received within a reasonable time (for example, 7 days after the invoice is sent, unless we agree to a different timeline), your order may be canceled. We will attempt to contact you via email reminders before any cancellation.
ToyMoy does not charge any late fees; however, we cannot start creating your custom model until payment has been successfully processed. Once payment is confirmed, we will notify you and begin the production process.
6.1 Production Time: Creating a custom 3D model from a drawing involves a detailed process. We will provide an estimated production time when you place your order (for example, it may take several weeks to model, print, and finish your item, depending on complexity and current order volume). Please note that this is an estimate and not a guarantee. We strive to meet the timeline and will keep you informed of any significant delays.
6.2 Shipping: We ship orders to the shipping address you provided. Currently, ToyMoy ships to addresses within [Canada/US/worldwide – specify based on business]. We will inform you if there are any restrictions on delivery locations at the time of order.
Once your custom model is printed, finished, and ready, we will carefully package it for shipment. You will receive a notification when your order ships, along with any available tracking information for the delivery.
6.3 Delivery Time: Delivery times will vary depending on your location and the shipping method. We will give an estimated delivery timeframe (e.g., 2 -3 weeks for domestic shipments) when we dispatch your item. However, please understand that once we hand your package over to the courier, delivery timing is outside our control. Weather, holidays, or carrier delays may affect actual delivery.
6.4 Shipping Costs: Shipping costs will either be included in your order total or listed separately in the invoice. Any applicable duties or customs fees for international shipments (if we offer international shipping) are the responsibility of the customer (we will warn you in advance if this applies).
6.5 Risk of Loss: We insure or require signature confirmation for higher-value shipments whenever possible to protect your purchase. The risk of loss or damage to the product passes to you upon delivery to your address (or when in your possession). If the package is lost in transit or arrives damaged, please see the Returns & Refunds section below for how we handle those situations.
6.6 Packaging: Your 3D model will be packaged securely. However, the models can be fragile. Please unbox carefully. If gifting to a child, ensure an adult handles the unpacking, especially if there is any protective wrapping or small packing materials.Because each ToyMoy product is custom-made for you based on a one-of-a-kind drawing, all sales are final. We cannot accept returns or exchanges for custom 3D models if you simply change your mind or are unsatisfied with the interpretation of the drawing. We appreciate your understanding that a great deal of time and effort goes into creating each personalized item, and it cannot be resold or repurposed.
However, we stand by the quality of our work. If there is a problem with your order that is due to our error or a defect, we will make it right. Specifically:
7.1 Reporting Issues: If you believe your product has a defect or error, you must contact ToyMoy customer support within 7 days of receiving the item

7.2 Resolution: Upon confirming that there is a manufacturing defect or an error on our part, we will work closely with you to find an appropriate resolution

We will discuss the options with you and find an agreeable solution. If the issue was damage during shipping, we will handle claims with the shipping provider and still ensure you receive a product you paid for (either the repaired original or a reprinted one).
7.3 Non-Returnable: Aside from confirmed defects or mistakes, custom products are not returnable. Minor imperfections or slight variations from the original drawing (for example, differences in color shading or proportional adjustments necessary for structural reasons) are not considered defects but rather a normal part of the artistic process of converting a 2D drawing into 3D. We ask that you review the preview (if provided) or descriptions carefully and understand the creative nature of the service.
7.4 Order Cancellations: Because our creation process starts quickly after payment and involves dedicated resources for your project, cancellations are generally not possible once we have begun working on your 3D model. If you need to cancel an order, contact us as soon as possible. If we have not started the modeling/printing process yet, we may, at our discretion, allow a cancellation and issue a refund. If work has already begun, we reserve the right to retain some or all of the payment to cover the work completed. (We’ll be fair and transparent about any such charges.)
Our goal is for you to be delighted with your ToyMoy experience. If you have any issues at all, please reach out and we will do our best to address them.
8.1 ToyMoy Website and Content: All content on the ToyMoy website, including text, images of example 3D models, graphics, logos, trademarks (such as the ToyMoy name and logo), button icons, and software, is the property of ToyMoy or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our website content without our express written permission. You are welcome to share our website via standard sharing features (like linking to us or sharing on social media with proper attribution), but scraping our content or using it for commercial purposes without permission is prohibited.
8.2 Use of ToyMoy Name: ToyMoy™ is our trademark. You are not permitted to use our name, logo, or branding in any way that might cause confusion or imply endorsement without our prior consent.
8.3 Your Content and Models: As stated in Section 4, you retain ownership of your original drawings. The 3D model design that ToyMoy creates based on your drawing is a product of your input and our creative work. ToyMoy retains ownership of any intermediate digital 3D files or techniques we use to create the model. However, the final physical model becomes your property once purchased and delivered to you. We will not reproduce or use your model for other purposes without permission. (On occasion, we may ask if we can feature a photograph of your finished model and the original drawing on our website or social media as an example of our work. We will only do so with your consent, and we will anonymize any personal details.)
ToyMoy provides its website and services “as is” and “as available”. While we strive for excellence, we cannot promise that everything will be perfect. To the fullest extent permitted by law, ToyMoy disclaims all warranties, express or implied, regarding the service and the products, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
What this means:
Product Use: We explicitly remind you that the 3D printed models we provide are not toys and have not been tested or certified as toys. They are meant for decorative or display purposes. We do not make any warranties regarding the suitability or safety of the product for use by young children. You assume responsibility for how the product is used once it is in your possession. Please supervise children if they are handling the model, especially if they are under 3 years old, as small parts could pose a choking hazard.
To the maximum extent allowed by applicable law, ToyMoy and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or products. This includes, for example, damages for lost profits, loss of data, emotional distress, or other intangible losses, even if we have been advised of the possibility of such damages.
In no event will our total liability for any claim arising from your use of the service or purchase of a product exceed the amount you paid to ToyMoy for that order. For instance, if you paid CAD $100 for a model, our liability to you for any issue with that order is capped at $100.
Some jurisdictions do not allow certain limitations of liability or exclusion of warranties, so some of the above disclaimers or limits may not apply to you. In such cases, ToyMoy’s liability will be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless ToyMoy and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with:
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
If any dispute or claim arises between you and ToyMoy relating to the service or these Terms, we encourage you to contact us first to attempt to resolve the issue informally. We value our customers and will try our best to address any concerns. If we cannot resolve the dispute informally, any legal action shall be brought in the courts of the Province of Ontario. You consent to the personal jurisdiction of such courts.
(If you are accessing the service from outside of Canada, note that you are responsible for complying with local laws, and you agree that any disputes will be handled in Ontario as stated.)
ToyMoy may revise or update these Terms from time to time. If we make material changes, we will notify users by posting the updated Terms on our website with a new “Last Updated” date, and/or by sending a notice via email if you have an account or an ongoing order. It is your responsibility to review these Terms periodically for any updates. By continuing to use the site or our services after any changes become effective, you agree to be bound by the revised Terms.
If you do not agree to the new Terms, you should stop using the site and services, and if applicable, inform us that you wish to discontinue your relationship (for example, cancel any pending orders if possible).
Entire Agreement: These Terms, along with our Privacy Policy and any order-specific agreements (like the details confirmed in email for a custom order), constitute the entire agreement between you and ToyMoy regarding the service. They supersede any prior agreements or communications.
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be deemed severable from the Terms and will not affect the validity and enforceability of the remaining provisions.
Waiver: If ToyMoy does not enforce a particular provision of these Terms in some instance, it does not mean we are waiving our right to enforce it in the future. Any waiver of rights by ToyMoy must be in writing to be effective.
Assignment: You may not assign your rights or obligations under these Terms to anyone else without our consent. ToyMoy may assign its rights and obligations to an affiliate or in the event of a merger or acquisition.
